In compliance with the order dated 09.01.2024 the respondent Nos. 4,5,6 and 7 are present in Court today. Their personal appearances are noted and dispensed with.

The report filed by the SI of Farakka Police Station, JPD dated 03.02.2024 stated that the appellant i.e. Mokbul Hossain has expired 25 years ago, respondent No. 1 i.e Moslem Shaikh has expired 16 years ago, respondent No. 2 i.e. Hamu Shaikh has expired on 02.01.2020 and respondent No. 3 i.e. Manu Shaikh has expired on 28.08.2019 supported by copy of the death certificates. Let the said report be kept on record.

Under the facts and circumstances, the instant appeal gets abated and accordingly disposed of.

Copy of the order as well as lower court records be sent to the trial court for information.
