Case No.258 of 2025 dated 27.10.2025 under Sections 109/118(2)/126(2)/3(5)/303(2)/351(3)/352 of the BNS, 2023.

And In the matter of: Sumit Majumder ... petitioner Mr. Amitava Ghosh ... for the petitioner Mr. Arindam Sen Md. Y.A. Ismail ... for the State Learned counsel for the petitioner submits that there was a free fight between friends. Some suffered injuries, but none was grievous in nature. The principal accused has been granted bail. Charge-sheet has been submitted. Learned counsel for the State opposes the prayer for anticipatory bail, refers to the statements of the victim and other eyewitnesses, relies on the injury report and submits that, as per the injury report, there was a cut injury on the scalp which required two stitches for repair and a fracture of the nasal bone. As per the statement of the victim, the present petitioner assaulted him with a bamboo stick and then with a brickbat.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
