Prabhat Kumar Singh & ORS. v. State Of West Bengal & ANR.
28.07.2021 Item no.11 Ct. No.34 CHC C.R.R. No.560 of 2012 (Via Video Conference) In Re: An application under Section 482 read with Section 401 of the Criminal Procedure Code.
AND In the matter of:- Prabhat Kumar Singh & ors.
... petitioners Mr. Binoy Kumar Panda, Ms. Pushpita Saha ...for the State The present revisional application was preferred challenging the proceedings relating to Entally Police Station Case No.99 of 2011 dated 21.03.2011, under Sections 498A/406/34 of the Indian Penal Code.
Records of the present revisional application reflects that at the time of admission of the revisional application on 07.03.2012, learned advocate appearing for the petitioners submitted that although a case was registered under Sections 498A/406 and 34 of the Indian Penal Code but there is a possibility of mutual divorce.
Having regard to the fact that petitioner approached this Court at the stage when the investigation of the case was under progress and the allegations in the F.I.R. prima facie made out offences, I am of the view that there is no scope for interference in the case which is the subject-matter of challenge. Further, no information has been submitted before this Court regarding the
present stage of the case as to whether charge-sheet has been filed or the trial has been concluded.
Thus, the revisional application being C.R.R.560 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
