Appeal No.8 of 2025 is under challenge in this application under Article 227 of the Constitution of India, Mr. Roy learned advocate appearing for the petitioner, on instruction, submits that he has instruction to pray for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court, Barrackpore to dispose of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure filed in connection with Title Suit No.781 of 2024.

Mr. Roy learned advocate appearing for the petitioner submits that the injunction application is otherwise ready for hearing and the next date for hearing of such application has been fixed on April 17, 2025. In view thereof CO 692 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court,

Barrackpore to take up the hearing of the application under Order 39 Rule 1 and 2 of the Code of Civil Procedure filed in connection with Title Suit No.781 of 2024, if the same is otherwise ready for hearing, on the next date fixed i.e., on April 17, 2025 and to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There will be no order as to costs.
