In the matter of : An application under Section 482 read with Section 401 read with Section 482 of the Code of Criminal Procedure.
The subject matter of challenge in this revisional application relates to a judgement and order dated 25th July, 2011 passed by the learned Additional Chief Judicial Magistrate, Purba Medinipur in connection with Miscellaneous Case No. 146 of 2005 wherein in an application under Section 127 of the Code of Criminal Procedure, the learned Magistrate was pleased to enhance the amount of maintenance of Rs.500/- per month to be paid to the minor son to a sum of Rs.1000/- per month to be paid to the minor son. Record reflects that the initial order was passed on 29th March, 2001 and the enhanced order for enhancement was passed on 25th July, 2011 i.e., after almost 10 years. Having regard to the quantum of maintenance which was initially awarded and subsequently enhanced by the order
passed on 25th July, 2011, I am of the view that the same do not call for any interference and the amount is a meagre one. As such, the present revisional application being CRR 572 of 2012 is dismissed.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
