Dan ... for the State The petitioner is aggrieved by the fact that in connection with NDPS Case No. 89 of 2021 arising out of Nabagram P.S. Case No. 121 of 2021 dated 19.5.2021, he is in custody for about two years nine months and, till date, out of the 10 witnesses so cited by the prosecution only three witnesses have been examined.

It has been informed that the next date has been fixed on 11th of April, 2024.

In view of the fact that the petitioner is in custody for a considerable period of time, I direct that the ld. Special Court would fix a schedule consisting of three dates and fix such schedule once in every month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

Special Court would inform to the Superintendent of Police, Murshidabad regarding the non-

availability of the witnesses concerned and the concerned Superintendent of Police would ensure regarding the availability of the witnesses and/or file a report regarding the reasons of non-availability on the date so fixed by the ld. Trial court.

Ld. Public Prosecutor conducting the case would produce materials, exhibits and documents for examination of the witnesses concerned. All efforts be taken by the stakeholders to conclude the trial at the earliest. With the aforesaid observations, CRR 738 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
