Affidavit-of-service filed by the petitioners be kept with the record.

Petitioners are aggrieved by the fact that in spite of inconveniences faced from the private respondents, the police authorities are not assisting them and there is every possibility of the private respondent encroaching the property of the petitioners in spite of the civil court having passed necessary directions in favour of the petitioners. State has submitted a report. Report deals with the nature of the accusations particularly with regard to a fair which is being held in a separate plot of land.

Be that as it may, since the civil court is in seisin of the issue and the petitioners require any

police assistance, in such case, if the petitioners prefer an appropriate application before the civil court and there are necessary/specific directions upon the police authorities by the civil court, police authorities then would respect, obey and implement the order. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any other untoward incident resulting from the strained relationship existing between the parties. With the aforesaid observations, WPA 4585 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
