Heard learned counsels for the parties.

The petitioner's vehicle has been flagged as 'Not to be transacted' by Murshidabad RTO on the ground that the vehicle is more than 15 years old and was plying in the KMA area. The petitioner undertakes to ply the vehicle beyond the KMA area upon obtaining fresh permit in respect of the vehicle from the concerned Regional Transport Authority.

In view of such undertaking, the order impugned flagging the vehicle as 'Not to be transacted' is set aside and the vehicle is released from the order of black listing. However, the petitioner shall not ply the vehicle in terms of the permit issued in his favour on 4th January, 1995. The petitioner is at liberty to apply for fresh permit before the concerned RTO for plying his vehicle outside the KMA area.

With the above observation, the writ petition is disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
