REJECTED C.R.M.(A) 654 of 2024 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Karandighi Police Station Case No. 471 of 2023 dated 16.08.2023 under Sections 498A/323/325/307/34 of the Indian Penal Code.

And In Re : Amir Hussain ...... petitioner Mr. Saikat Biswas Mr. Soumya Khan ...for the petitioner Mr. Prasun Kumar Dutta, Ld. APP., Mr. Palash Chandra Maiti ...for the State Defacto-complainant suffered injuries at the behest of the petitioner who is her husband. Neighbours implicate the petitioner before us in torturing the defacto-complainant both physically and mentally. They also implicate the petitioner in assaulting the defacto-complainant.

Police complaint was lodged within one year of marriage. Petitioner allowed his earlier application being C.R.M. (A) 5168 of 2023 to be dismissed for default on January 30, 2024. Petitioner did not take any steps for getting such application restored.

In such circumstances, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected.
