1. It is submitted that the present petitioner is similarly circumstanced with the other co-accused in favour of which the bail order has been granted. Moreso, he is in custody for more than two years and two months and when the other co-accused were enlarged much before that period.

2. Further submission advanced that initially the offending weapon was recovered at the instance of a witness who was a seizure list witness and within two days he changed his status to eye witness. Therefore, it is submitted that the present petitioner is also entitled to be released on bail.

3. The prosecution raises objection.

4. Perused the materials on record.

On careful consideration of the entire facts of the case and the statement recorded under Section 183, B.N.S.S by Kamal Sk where the petitioner is found alongwith the other co-accused who are enlarged on bail and in a way it is apparent that he is similarly circumstanced with the other co-accused, this Court finds no reason not to allow the prayer of the petitioner.

6. Hence the prayer stands allowed.

7. CRM(M) 558 of 2026 is disposed of.

Accordingly, it is ordered that the petitioner, namely, Ekramul Mondal @ Akramul Mondal @ Surat @ Akram Mondal be released on bail upon furnishing a bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Tehatta, Nadia.

If on bail, the petitioner shall stay outside the jurisdiction of the learned Additional Chief Judicial Magistrate, Tehatta, Nadia except for the purposes of attending the Court. the petitioner shall also inform the address to the learned Additional Chief Judicial Magistrate, Tehatta, Nadia as also to the Inspector-inCharge, Tehatta Police Station. 10.

The learned Additional Chief Judicial Magistrate, Tehatta, Nadia or the learned Trial Court would, if it feels necessary, impose other conditions as it deems fit and proper.

In the event the petitioner fails to adhere to any of the conditions stated above without any justifiable cause, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. 12.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 13.

Urgent certified photostat copy of this order, if applied, for be supplied to the parties upon compliance with all requisite formalities.
