01.04.2024 IN THE HIGH COURT AT CALCUTTA Sl. No.10 CONSTITUTIONAL WRIT JURISDICTION (PP) APPELLATE SIDE WPA 3489 of 2011 Sri Tapan Sil & Ors.

Vs.

The State of West Bengal & Ors.

On the file being sent by the department, this matter was placed in the list. It is running in the list for several weeks and has been called on from time to time.

No one has ever responded when the matter has been called on. The matter, therefor, was placed in the list with the note "First Chance". No one responded even at this stage. Then the matter appeared in the list marked as "Last Chance". Despite being called on several times when the matter appeared in the list marked as "Last Chance", no one appeared.

Eight numbers of casual workers in R.S.I.

Limited (Unit-II), being the respondent no.5 had filed this writ petition in 2011 for consideration of their representation to enlist them under the Financial Assistance of Workers of Lockout Industries (FAWLOI) scheme since the representation was not adhered to by the concerned Labour Commissioner (respondent no.2).

It further appears that with the passage of time the same has become infructuous and as such, the petitioners are no more interested to proceed with the writ petition. The same is accordingly disposed of without any order.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
