Learned advocate appearing for the petitioners is directed to serve a copy of this revisional application upon Mr. Madhusudan Sur, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

On perusal of the contents of this revisional application, I find that the case was initiated in the year 2021 and the petitioners approached this Court at a stage when the investigation, prima facie reflects, was still continuing. Having considered the stage at which the petitioners approached this Court and the issues so raised by Mr. Basu, learned advocate appearing for the petitioners, I find that there is civil dispute between the residents of the same building. However, appreciating the factual circumstances it would not be fit and proper within the scheme of Section 482 of the Code of Criminal Procedure to interfere at this stage. The petitioners would be at liberty to approach this Court at an appropriate stage of the proceedings.

In case the petitioner no.1 is required for the sake of investigation, a notice be served upon her by affording her at least one week's time for her appearance.

With the aforesaid observations, the revisional application being CRR 681 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
