Calcutta Electric Supply Corporation Limited Mr. Abhijit Ray .... for the petitioner Mr. Suman Ghosh .... for the CESC Limited Learned counsel for the petitioner submits that although the petitioner is enjoying electricity connection in one premises, a different billing address is being indicated by the Calcutta Electric Supply Corporation Limited (CESC Limited) in its bills issued for such connection.

It is contended further, by placing reliance on the photocopy of the certified copy of an ex parte decree, whereby specific performance of a contract was granted in favour of the petitioner, to indicate that the petitioner has entitlement to the premises. Learned counsel for the CESC Limited submits that nothing has been produced by the petitioner before the CESC Limited to establish that the address at which the bill is being raised is incorrect.

Hence, it is submitted that in the event appropriate documents are produced in that regard by the petitioner, there is no difficulty on the part of the CESC Limited to consider the representation of the petitioner.

In such view of the matter, WPA No. 4494 of 2023 is disposed of by directing the CESC Limited to dispose of the representations annexed at pages-20, 23 and 24 of the writ petition, upon giving an opportunity to the petitioner to produce all relevant documents and of hearing, as expeditiously as possible, preferably within three weeks from date. Upon such consideration, the CESC Limited shall take appropriate steps with regard to the said representations.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
