The legal representation filed on behalf of the petitioner seeking return of the sum of Rs.21,80,000/- along with interest which is held in fixed deposit bearing FDR No. 42279 dated 24.10.2004 is pending consideration before the Director, Directorate of Enforcement.

Learned Advocate for the petitioner submits that the petitioner stood acquitted in the criminal case before three judicial fora. The order of attachment, however, is pending consideration before Appellate Tribunal for Foreign Exchange.

Without entering into the merit of the prayer of the petitioner, the instant writ petition is disposed of by directing the respondent no. 2 being the Director, Directorate of Enforcement to consider and dispose of the representation filed on behalf of the petitioner in

accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order. If the prayer of the petitioner is accepted, then necessary remedial steps shall be taken.

The writ petition is disposed of.
