The petitioners were never informed regarding the outcome of the investigation. The petitioners approached the Learned Magistrate/trial court with a prayer for further investigation under Section 173(8) of the Cr.P.C. but the same was not entertained by the concerned court.
The learned Court in seisin of
Talpatighat Coastal P.S. Case No. 111 of 2023 would assess whether any notice was served upon the defacto-complainant.
In case, no notice has been served, the defacto-complainant should be granted permission to file an application under Section 173(8) of the Cr.P.C. The learned Magistrate will consider the same on merits, thereafter, dispose of the same in accordance with law within a period of 15 days from the date of filing of the application.
With the aforesaid observations, WPA 4616 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Since affidavits have not been invited, the other allegations made in the writ petition are deemed not to have been admitted.
