Mrs. Sabita Khutia (Bhunya) ... for the Petitioner The grievance of the petitioner is that even though he retired from service on 28th February, 2014 but he is being paid pension on and from 16th September, 2014, that is, the date on which he refunded the employers' share of contribution. There no record to prove that the petitioner refunded the amount of the employers' share on the said date.

Accordingly, no relief can be granted to the petitioner in the instant case.

The writ petition fails and hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
