1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Learned advocate representing the petitioner questions veracity of death certificate issued on 13th May, 2005 of one Gopal Chandra Sardar.

Notice of this Court is also drawn to order of the Sub-Divisional Officer, Baruipur, South 24 Parganas dated 15th July, 2025 whereby possession of some plots were directed to be given to private respondents. Petitioner filed Title Suit No. 495 of 2025 before 3rd Civil Judge (Jr. Division) Baruipur and it is submitted that an interim order of injunction was passed directing the defendants not to disturb

peaceful possession of the suit property of the plaintiff till 8th September, 2025.

3. Petitioner prays for direction upon the police authorities to take necessary steps taking note of the allegation that death certificate of Gopal Chandra Sardar is forged.

4. Learned advocate representing the State respondents has filed one communication dated 23rd March, 2026 of Inspector-in-Charge, Kultali Police Station, Baruipur Police District and same is taken on record.

5. It is disclosed in the said communication dated 23rd March, 2026 that there is a long pending dispute over the lands in question between the petitioner and private respondents and petitioner instituted Title Suit No. 495 of 2025 which is pending. It is also stated in the communication that considering situation prevailing at the locale one Kultali P.S. NCR No. 162/26 dated 20th March, 2026 under Section 126/135(3) BNSS was initiated to maintain peace and tranquility at the locale.

6. Since suit is pending before the Civil Court petitioner shall be at liberty to take steps in the pending suit in pursuit of remedy.

7. Concerned police authorities are also directed to maintain peace and tranquility at the locale

and to keep vigil in order to ensure that no untoward incident takes place.

8. With the aforesaid observations and directions writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
