The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with. The 10th Court of learned Civil Judge (Senior Division) at Alipore, District: 24-Pargans (South) is hearing two suits being Title Suit No. 24 of 2014, a suit for specific performance of agreement and Title Suit No. 56 of 2011, a suit for eviction, analogously.

The petitioner is the plaintiff of the said Title Suit No. 56 of 2011, and is praying for a direction for expeditious disposal of the said two suits.

It appears from the orders passed in the said suit that they are not yet ready for disposal inasmuch as the applications connected with the suits are pending and issues have not yet been framed, therefore, the direction as prayed for is prematured. C.O. 603 of 2024 is disposed of with the above observations without any order as to costs.
