Datta Mr. Santanu Deb Roy .....For the State This is an application under Section 439 of the Code of Criminal Procedure filed on behalf of the petitioner who has sought for his release on any condition. Learned counsel for the petitioner submits, though the offence alleged is under Section 6 of the Protection of Children from Sexual Offences Act, but, no injury is revealed on the private part from the medical report.

Learned counsel for the State pressed in service the case diary and invites our attention to the statement of the victim girl aged about 7 years recorded under Section 164 of the Criminal Procedure Code. Having heard learned counsel for the parties and considering the statement of the victim girl before the learned Magistrate and the nature of offence, the prayer for bail is rejected.

Accordingly, C.R.M. 1983 of 2021 is dismissed.
