Mitra Mr. Subhabrata Das ......For the State The petitioner claims ownership over Plot No. 2993, J.L. Dag No. 20, under Mouza-Boinchigram, DistrictHooghly. It is alleged that Respondent Nos. 7 and 8, despite having no right, title, or interest in the said property, have raised a construction without obtaining any permission from the Panchayat Authority. It is further submitted that a partition suit is pending between the parties, in which an order of injunction has been passed restraining Respondent Nos. 7 and 8 from changing the nature and character of the property.

Photographs of the impugned construction have been produced before this Court. It appears that the construction is of recent origin and remains incomplete. The petitioner further alleges that despite her representation dated 11th February, 2025, addressed to

the Panchayat, no action has been taken by the Panchayat Pradhan.

In view of the aforesaid, WPA 4593 of 2025 is disposed of with a direction upon the Panchayat Pradhan, Bantika Boinchigram Gram Panchayat, Respondent No. 5, to consider the representation dated 11th February, 2025, and, if any unauthorised construction is detected on the relevant plot, to take appropriate steps in terms of Section 23(5) of the West Bengal Panchayat Act, 1973. The entire exercise shall be completed within a period of two weeks from the date of communication of this order.

Accordingly, WPA 4593 of 2025 stands disposed of.
