SL. 14 27.02.2026 Court No.19 BP WPA 4661 of 2026 Bishnupada @ Bishnu Karmakar -versus- The State of West Bengal and others Mr. Sujit Kumar Ghosh Ms. Patakashree Roy ..for the petitioner Mr. Sadhan Kumar Halder Ms. Tanuja Basak ..for the State The petitioners have prayed for a direction upon the respondent authorities to pay adequate and proper compensation to the petitioners in respect of the land of the petitioners situated within Mouza Chandipur in the District of Birbhum.

The learned advocate appearing for the petitioners submits that the property of the petitioners has been utilized for a public purpose but no compensation has been paid to the petitioners.

Heard the learned advocate for the State on such submission.

It appears that pursuant to an order dated 19th September, 2016 passed by a Co-ordinate Bench in WP 14326(W) of 2016 a hearing was conducted by the Land Acquisition Collector and Special Land Acquisition Officer, Birbhum and an order has been passed on 20th January, 2017 giving liberty to the petitioners to file a fresh

representation with the basic details as indicated in the order dated 20th January, 2017. No document has been produced before this Court to show that the directions passed in the said order dated 20th January, 2017 has been complied with by the petitioners.

WPA 4661 of 2026 stands disposed of by leaving the petitioners free to comply with the directions contained in the order dated 20th January, 2017 passed by the Land Acquisition Collector and Special Land Acquisition Officer, Birbhum and if the said directions are complied with the respondent authority shall consider the same in accordance with law.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
