This is an application under Article 226 of the Constitution of India wherein the writ petitioners are aggrieved by the use of wrong answer keys in respect of certain questions in the written test of History subject in the recruitment process conducted by the West Bengal Central School Service Commission (in short 'Commission') for the year 2016. Owing to the same, the writ petitioners have lost marks that should genuinely have been awarded to them.

The Court had itself examined the relevant questions and found out that out of the four questions in issue, only two are required to be rectified. In view of the above, I direct the Commission to award marks to the writ petitioners herein in the event, the answers to question No.6 is either (a) or (b) and

also in question No.40 if the answer is (b). The Commission shall reevaluate the answer-sheet (for the above two questions only) of the writ petitioners and award marks as provided above.

In view of the above direction, this writ petition is disposed of without however, any order as to costs. All parties are to act on the website copy of this order.
