Minakshi Khan v. State Of West Bengal & ORS
06.05.2022 sayandeep Sl. No. 02 Ct. No. 05 CPAN 375 of 2020 In WPA 3527of 2019 With IA NO: CAN/1/2020(Old No. CAN/4480 of 2020) Smt. Minakshi Khan -Versus- Smt. Paromita Roy & Ors.
Mr. Tanmoy Mukherjee Mr. Souvik Das Mr. Rudranil Das ...... for the petitioner Ms. Koyeli Bhattacharyya ..... for the alleged contemnor No. 1 Ms. Chaitali Bhattacharyya .... for the alleged contemnor No. 2 Mr. Partha Srathi Bhattacharyya Mr. Raju Bhattacharyya ..... for the alleged contemnor No. 3 From the submissions of learned counsel appearing for the petitioner, the concerned School, the Board and the D.I. (the last three being the alleged contemnors), it appears that an order passed by this Court on 26.06.2019 directing the respondents to release the arrear salary of 115 days to the petitioner in terms of a Resolution taken by the Managing Committee of the School on 11.03.2014 within a certain time frame has not been complied with.
While it is submitted on behalf of the Board that the petitioner and the School have not attended the hearing before the Board, the case of the D.I. is that the Board failed to take any steps pursuant to the order passed by this Court. The case of the School is that despite two letters written to the Board and the D.I. in September, 2019, the D.I. and the Board have not taken any steps.
Learned counsel appearing for the School submits that the arrear bills of the petitioner were forwarded to the Board and the D.I. Although there appears to be a definite shifting of the responsibility between the alleged contemnors with the resulting effect that the order passed by this Court has not been complied with, this Court is of the view that for the effective compliance of the order, the parties should be directed to attend a meeting before the Board on a designated day so that the pending issues can be sorted out.
As suggested by learned counsel appearing for the parties, the School and the D.I. as well as the petitioner are directed to meet the Board on 13th May, 2022 at 2 P.M.. The Board shall give hearing to these parties and ensure that the direction passed by this Court is complied with within seven days from 9th May, 2022. List this matter on 20th May, 2022.
The parties are directed to produce all relevant documents before the Board on 13th May, 2022. In Re: CAN/1/2020 (Old No. CAN/4480 of 2020) CAN/1/2020 (Old No.
CAN/4480/2020) is disposed of accordingly.
