Mr. Sen, Senior Advocate appearing on behalf of the State submits that the petitioner is illegally occupying the subject premises and is not entitled to any long term lease as a matter of right. He also refers to an earlier writ petition being W.P.No. 1966(W) of 2018 for similar reliefs which was withdrawn with liberty to file afresh by the petitioner.

I have considered the submissions of the parties. I am of the view that the petitioner has been unable to demonstrate any enforceable legal right to maintain this writ petition. It is an admitted fact that the petitioner is unauthorisedly in occupation of the subject premises and cannot now seek a direction on the State-respondents to grant a long term lease as a matter of right.

In view of the aforesaid, there is no merit in this writ petition.

Accordingly, WPA No. 3536 of 2019 is dismissed. There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
