Banerjee) Dr. Sutanu Kumar Patra Mr. Saptarshi Dutt ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the complainant in a Complaint Case being No. CC/164/2020, pending before West Bengal State Consumer Disputes Redressal Commission, Kolkata, praying for a direction upon the said Commission to dispose of the complaint case expeditiously.
Dr. Patra, learned advocate for the petitioners, submits that the hearing of the complaint case is being adjourned from time to time at the instance of the opposite party herein.
In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order to the opposite parties forthwith.
From the order-sheets appended to this civil revision application, more particularly from the order dated December 20, 2024, this Court finds that March 12, 2025 has been fixed for filing evidence on affidavit by the opposite party nos. 1 and 13 as the last chance.
It appears from the order-sheets that several opportunities were granted to the opposite party nos. 1 and 13 to file such evidence on affidavit.
If the evidence on affidavit of the opposite party nos. 1 and 13 is not filed on March 12, 2025, the West Bengal State Consumer Dispute Redressal Commission is requested to pass necessary orders in the Complaint Case No. CC/164/2020 and no further opportunity should be granted to the said opposite parties to file evidence on affidavit.
The Commission is requested to dispose of the Complaint Case No. CC/164/2020 as expeditiously as possible, preferably by the end of November, 2025, without granting any unnecessary adjournment to either of the parties.
With the above observations, CO 697 of 2025 stands disposed of.
