No. 29 CHC REJECTED C.R.M.(NDPS) 359 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Andal Police Station Case No.228 of 2022 dated July 01, 2022 under Sections 22(C)/25/28/29 of the Narcotic Drugs and Psychotropic Substances Act.

...... petitioners Ms. Sreyashee Biswas ....for the petitioners Mr. Saryati Datta ....for the State Petitioners were arrested from the vehicle from which, commercial quantity of narcotics were seized. Possession of the petitioners over the commercial quantity of narcotic at this stage cannot be overlooked. In such circumstances, the petitioners are unable to overcome the restriction under Section 37 of the N.D.P.S. Act, 1985.

The Court is informed that the next date for the purpose of trial is on March 10, 2023.

Considering the period of detention of the petitioners, it would be appropriate to request the learned trial Judge to

invoke the provision of Section 309 of the Criminal Procedure Code and dispose of the trial as expeditiously as possible. C.R.M.(NDPS) 359 of 2023 is dismissed.
