Mr. Krishanu Banik Ms. Sreemayi Roy ...For the Respondents/Claimants The Instant appeal is directed against the judgment and award dated September 30, 2015 passed by the learned Additional District & Sessions Judge, Motor Accident Claims Tribunal, Fast Track, 1st Court Contai, Purba Medinipur, in M.A.C. Case No. 09 of 2012.
Mr. Krishanu Banik, learned Counsel appearing on behalf of the respondents/claimants submits that the insurer and claimants have reached a settlement and the Insurance Company has already paid the settled amounts to the claimants/respondents.
Mr. Singh, produces the photocopy of the document of the Court of learned Additional District Judge, Fast Track 1st Court, Contai, Purba Medinipur, confirming the details of the cheques paid by the Insurance Company to the claimants/respondents. Photocopy of the said document is placed before this Court and the same is kept with the record.
In light of the above submissions, the Registrar General is directed to refund the statutory amount of Rs.25,000/- along with accrued interest to the Insurance Company within a period of four weeks from date. The Insurance Company is directed to make an appropriate application forthwith before the Registrar General of this Court.
With the aforesaid directions the instant appeal is disposed of.
There shall be no further order as to costs.
LCR, if any, may be returned back to the Court below.
Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
