Subarna Chowdhury v. State Of West Bengal
20.04.2022 Sl. 48 Court No.29 suvayan (rejected) C.R.M. (DB) 700 of 2022 In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 08.03.2022 in connection with Dankuni P.S. case No. 248/2020 dated 14/12/2020 under Sections 302, 34 of the Indian Penal Code.
And In the matter of: Mrs. Subarna Chowdhury ....petitioner.
Mr. Pratip Mukherjee Mr. Omar Faruk Gazi Ms. Rima Banerjee ...for the petitioner.
Mr. Sudip Ghosh Mr. Bitasok Banerjee ...for the State.
Petition is taken up for consideration subsequent to the order dated March 24, 2022.
The Court is informed that the charges were framed. The next date fixed is May 5, 2022 for the purpose of recording evidence of the prosecution.
Learned Advocate appearing for the petitioner submits that there is a daughter of 15 years of age which the petitioner needs to look after. The petitioner should be enlarged on bail considering the period of detention of the petitioner and the fact that the petitioner needs to look after the daughter.
Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that the victim was set on fire by the petitioner and that the petitioner resisted members of the public who tried to douse flame and rescue the victim.
Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant bail to the petitioner. Moreover, there
is hardly any material change in circumstances subsequent to the earlier order of rejection.
Accordingly, the prayer for bail of the petitioner is rejected. C.R.M. (DB) 700 of 2022 is dismissed.
