Petitioner is aggrieved by the fact that his services were assessed in terms of gold and to that extent, he was entitled to 52.950gms.

of gold from the private respondents. The petitioner lodged complaint with the police authorities to that effect on or about 08.01.2024. However, the police authorities till date did not take appropriate steps.

I have considered the report which has been submitted by the State which do not reflect that the police authorities have registered a case but they have conducted an enquiry and is of the opinion that the jurisdiction should be at Chennai, Madurai.

Be that as it may, in view of the nature of the accusations, I grant liberty to the petitioner to approach the jurisdictional Court under Section 175(3) of the BNSS. Learned Magistrate will assess regarding the factum whether any cognizable offence is made out and thereafter

assess whether any case for investigation is made out and then only pass necessary directions.

With the aforesaid observations, the instant writ petition being WPA 4621 of 2024 is disposed of. Report so submitted be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
