Learned Counsel for the petitioner submits no stolen property was recovered from his possession. Principal accused Bibek Mondal has been granted regular bail. He prays for anticipatory bail.

Learned Counsel for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. Bibek Mondal and others were illegally smuggling mobile phones across international border. BSF personnel arrested Bibek. Other miscreants ran away. On interrogation complicity of the petitioner as one of the smugglers has transpired. 4.

In light of the nature of crime we are of the opinion custodial interrogation of the petitioner is necessary for the purpose of unraveling the ramifications of the crime and may

lead to further recoveries. Hence, we are not inclined to grant anticipatory bail to the petitioner.
