Petitioner(s) Mr. Abhimanyu Banerjee Mr. Arnab Saha ... for the Petitioner(s) Mr. Madhusudan Sur, APP Mr. Amanul Islam ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated in connection with the instant case where there has been alleged recovery of 1 kg 720 gm of brown sugar. Learned advocate added that the petitioner has been implicated only on the basis of statement of a coaccused and there has been no recovery from the present petitioner. Further, it has been stated that there is neither any money trail nor any CDR available against the present petitioner.

Learned advocate for the State opposes the prayer for bail and submits that, although, there has been no recovery from the present petitioner, but, there may be oral evidence.

Having considered the same and the fact that the petitioner is in custody for more than four months, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Rabiul Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court (NDPS Act)-cum-Learned Additional District and Sessions Judge, 4th Court, Malda.

If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned Special court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Special Court.

Accordingly, CRM(NDPS) 386 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
