Petitioner is in custody for more than a year. He submits there is little possibility of trial concluding in the near future. Co-accused are on bail. Accordingly, he prays for bail. 2.

Learned Advocate for the State opposes the bail prayer. He submits report. The same be kept on record. He contends date has been fixed for recording prosecution evidence on 18th April, 2024.

We have considered the materials on record. Petitioner is involved in a racket to dupe innocent individuals through cyber fraud. Though the profile of the allegations disclose an organised crime activity, we note petitioner is in custody for a protracted period of time. Co-accused are on bail. Prosecution proposes to examine 30 witnesses and there is no possibility of trial concluding in the near future.

Under such circumstances, we are inclined to grant bail to the petitioner.

Accordingly, the petitioner viz., Jeet Saha shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Bankura subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

6. In the event petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
