Learned advocate appearing for the petitioner submits that the petitioner has been arrested and is in custody for 670 days. The alleged recovery in the present case is of 300 grams of brown sugar and a co-accused has been granted default bail under Section 36A(4) of the NDPS Act.

It has been pointed out on behalf of the State that the evidence of the case has already been concluded and date has been fixed for examination of accused under Section 313 of Cr.P.C. Learned advocate for the petitioner to this aspect submitted that at least on four dates the recordings under Section 313 of the Cr.P.C. was not done.

Having considered the facts of the case which is at an advanced stage, I am not inclined to release the petitioner on bail.

However, I direct the learned trial Court to conclude the arguments and pronounce its verdict by 30th June, 2026. Accordingly, CRM (NDPS) 387 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
