For the petitioner This application under Article of the Constitution of India has been filed with a prayer for expeditious disposal of an application under Order XXVI Rule 9 of the Code of Civil Procedure in connection with Title Suit No.187 of 2016 pending before the learned Civil Judge (Senior Division), Sealdah, South 24-Parganas. Considering the nature of prayer, i.e., expeditious disposal, I find hardly any necessity to ask for service of notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with. The learned Civil Judge (Senior Division), Sealdah, South 24-Parganas, is requested to dispose of the application under Order XXVI Rule 9 of the Code of Civil Procedure on the date fixed for hearing, i.e., on 27th March, 2023, positively, after giving an opportunity of hearing to the parties to the suit.

With the above observation, the revisional application, being CO 608 of 2023, stands disposed of.

Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Senior Division), Sealdah, South 24-Parganas, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court without insisting upon production of a certified copy thereof.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
