The petitioners had participated in the recruitment process initiated by the West Bengal Board of Primary Education for appointment of Assistant Teachers in Primary Schools vide Memo No. 1573(PartI)/WBBPE/2022 dated October 21, 2022. The candidature of the petitioners was not considered by the Board as they do not have two years regular Diploma in elementary education; instead, they have eighteen months diploma conducted by NIOS through ODL mode.

The Hon'ble Supreme Court in the decision of Jaiveer Singh & Ors. Vs. State of Uttarakhand & Ors., reported in 2023 SCC Online (SC) 1584 has held that the training qualification possessed by the petitioners is not a valid training qualification for appointment in the post of Assistant teachers at primary schools; therefore, the rejection of the candidature of the petitioners in the said recruitment process cannot be faulted.

W.P.A. 4752 of 2024 is therefore dismissed without any order as to costs.
