Petitioner is aggrieved by the fact that inspite of Dantan Police Station case no. 10/24 dated 19.01.2024 registered under Sections 498A/406/323/34 of the Indian Penal Code, the investigating authority did not seize the stridhan articles. Learned advocate appearing for the petitioner submits that there has been no progress of investigation as no efforts were taken by the investigating officer.

State has submitted a report which reflects that charge-sheet was submitted on or about 31.03.2024 in connection with the instant case and the report encloses a document being a photostat copy of notarized stamp paper wherefrom the State intended to substantiate that in the year 2022 the stridhan articles were received by the relations. Subsequently, in course of investigation raid was conducted, however the seizure list consequently reflected that there were no seizures. The report also

reflects that no such shop under the name of Swasti Avarani exists.

Be that as it may, since the charge-sheet has already been submitted before the Jurisdictional Court petitioner would be at liberty, if she is aggrieved to prefer an application under Section 173(8) of the Cr.P.C. The report placed before this Court be also taken into consideration by the learned Magistrate before deciding on the issue where further investigation is required or not.

With the aforesaid observations WPA 4641 of 2025 is disposed of.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
