Affidavit of service filed by the petitioner be kept with the record.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 27th October, 2022 and the evidence has not commenced although charge was framed on 05th September, 2023.

Learned advocate appearing for the State submits that supplementary charge-sheet was submitted in the month of November, 2023.

Having regard to the fact that the petitioner is in custody for one year and four months, I am of the view that the learned trial court on and from the next date would take efforts so that every 45 days a schedule of three dates are fixed and the trial of the case can be taken to its logical conclusion within a reasonable period of time. If any witness is not available, the learned special court would communicate with the Superintendent of Police of the concerned

District who would submit a report before the court regarding the availability of the witnesses and if a witness is not available, a report be submitted before the court. No unnecessary adjournment be granted to any of the parties. Learned public prosecutor conducting the case would produce all the materials, documents and exhibits on the date so fixed for examination of the witnesses. All stakeholders would cooperate with the trial court to conclude the trial at the earliest.

With the aforesaid observations, CRR 746 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
