The petitioners are beneficiaries of essential commodities through fair price shop previously situated at Kaliganj Bazar. After the death of the original licence holder the fair price shop was shiftd
from Kaliganj Bazar to Narayanpur. The ration shop situated at Kaliganj Bazar used to cater the beneficiaries who are residents of three adjacent villages. After the FPS shop was shifted to Narayanpur the villagers made a mass representation before the District Magistrate, Nadia disclosing their grievance that they would have to travel a long distance to collect ration materials from the FPS shop at Narayanpur. Therefore, they want an establishment of FPS shop at village Kaliganj.
It is submitted by the learned advocate on behalf of the SubDivisional Controller, Food & Supplies, Krishnanagar at Nadia that the representation of the local villagers was duly taken care of. The beneficiaries were interrogated by the Chief Inspector, Food & Supplies and other officers of the department. The beneficiaries disclosed that they will have no problem if the FPS shop is situated at Narayanpur so long the ration materials are supplied under the scheme "Duaray Ration Project". At present they are getting ration materials at their doorstep. However, they will face problem if the said project is stopped by the Government.
Considering the submission made by the learned advocate for the petitioner as well as the learned advocate for the State Respondents the instant writ petition is disposed of directing the SubDivisional Controller, Food & Supplies Department to consider if the
FPS can be opened at village Kaliganj in future in case "Duaray Ration Project" is stopped by the State Government.
With the above direction, the instant writ petition is disposed of.
There shall be no order as to costs.
