The report reflects that an ex parte order was passed by the ld. Civil Judge (Jr. Division), 2nd Court, Hooghly Sadar on 07.12.2018.
However, no execution case was preferred. So far as the dispute is concerned relating to the incident, police has already recorded Dadpur P.S. Case No. 69 of 2019 and, there are proceeding(s) in respect of breach of peace and tranquility, as also, proceedings under Section and
Section 116(3) of the cr.p.c. have been initiated by the police authorities and the Executive Magistrate(s) concerned are dealing or have dealt with the same.
Strict vigil of law and order have also been maintained by the police authorities.
So far as the civil dispute and the decree/order passed by the ld. Civil Court is concerned, it would be the duty of the petitioner to approach appropriate forum.
So far as the act and actions of the police authorities are concerned, the same are justified and, as such, no interference is called for.
However, the police authorities would see to that no breach of peace takes place at the locale.
With the aforesaid observations, WPA 3598 of 2020 is disposed of.
Pending application, if any, is also disposed of.
