The petitioner was an Assistant Teacher of Shree Vishuddhanand Sarasawati Vidyalaya, Kolkata. The representation of the petitioner for condonation of shortfall of the qualifying service to get the benefit of pension is pending before the District Inspector of Schools (SE), Kolkata, the respondent no. 3 herein. The said representation is appearing at page 33 of the writ petition being Annexure - P-6.

The respondent no. 3 is directed to consider and dispose of the said representation of the petitioner in accordance with law after giving the petitioner and the school authority opportunity of hearing.

The respondent no. 3 shall make his deliberation on the referred issue within a period of four weeks from the date of communication of this order and in the event the petitioner is found to be eligible for such

pensionary benefits the said respondent shall take follow up steps.

The petitioner is required to serve a complete copy of the writ petition upon the respondent no. 3. W.P.A. 4576 of 2023 is disposed of with the above observations without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
