Pursuant to the direction dated March 25, 2022, the learned advocate for the petitioner has carried out the necessary amendment in the prayer portion of the writ petition.
Since the alternative prayer for compensation has been incorporated now in the writ petition, there is no bar in the court passing an order on such count.
The petitioner, at this juncture, restricts his prayer to adequate compensation being disbursed by the Power Grid Corporation.
Since law, in any event, contemplates such a procedure, that is, the Power Grid Corporation, which is
undertaking the work, shall assess and disburse the compensation to the persons entitled, if any, WPA 4388 of 2022 is disposed of by directing the Power Grid Corporation, that is, the respondent no.3 to pay adequate compensation to the petitioner, in the event the petitioner is found entitled to such compensation on the basis of having a right to the property which might be damaged in the process of the work, and to disburse such amount in favour of the petitioner, if so entitled.
It is expected that such adjudication and disbursal shall be done as expeditiously as possible after the completion of the work.
There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
