Petitioner is aggrieved by the fact that in spite of accusations against police officers and the learned Additional Chief Judicial Magistrate, Arambagh, Hooghly holding that there were serious accusations, directed the Officer-in-Charge, Goghat Police Station to conduct an enquiry.

State has submitted a report which reflects that earlier Goghat Police Station Case No. 411 of dated 22.11.2023 was registered for investigation and subsequent to the same, chargesheet was submitted before the jurisdictional court under Section 306 of the Indian Penal Code.

Petitioner also filed an application being M.P. Case No. 320 of 2023 under Section 156(3) of the Code of Criminal Procedure. However, the police report reflects that the said case under Section 156(3) of the Code of Criminal Procedure was

disposed of on 06.02.2024 by the learned ACJM, Arambagh.

Having considered that the application of the petitioner was finally disposed of, I am of the view that at this stage, this Court is not in a position to assess regarding the correctness of the order passed by the learned Magistrate or the merits of the report on the basis of which enquiry was conducted. If the petitioner is aggrieved, petitioner would approach the jurisdictional court for necessary reliefs. No interference is called for by this Court.

Accordingly, the writ petition being WPA 4860 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
