CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 607 of 2011 In the matter of : M/s. U. D. Enterprise. .....petitioner. In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred in the year 2011. Record reflects that the revisional application till date has not been presented and as such the same has not been admitted.

The grievance of the petitioner relates to rejection of an order under Section 205 of the Code of Criminal Procedure in a case under Section 138 of the N. I. Act. As no information has been furnished today when the matter has been taken up whether the present complaint case is pending or not, I am of the view that any order which has been passed in such revisional application may embarrass this court or the learned Magistrate's court. However, for the ends of justice, if the proceedings are still pending, the learned Magistrate would be at liberty to

consider the issue of physical presence of the petitioner or dispensation in the day-to-day proceedings.

However, no interference is required by this court for the present.

Accordingly, the present revisional application being CRR 607 of 2011 is dismissed.
