Mr. Arpan Guha, Mr. Saikat Dey ...for the Petitioner Mr. Sujit Sankar Koley ...for WBSEDCL 06-05-2025 AKG Ct. 15 It is undisputed that the West Bengal State Electricity Distribution Company Limited (WBSEDCL) issued a final assessment order requiring the petitioner to deposit a sum of ₹5,19,712/- on the allegation of electricity theft. Pursuant to this order, the petitioner deposited ₹2,59,856/- on August 22, 2016.
In addition to the aforementioned amount, WBSEDCL has raised a further claim of ₹4,80,983.078/- towards a late payment surcharge.
Learned counsel appearing on behalf of WBSEDCL has submitted before this Court that, should the petitioner make a representation before the Waiver Committee, the petitioner's request may be considered sympathetically. In light of the above submission by WBSEDCL, the petitioner is directed to deposit a sum of ₹1,50,000/-, along with the applicable reconnection charges, within two weeks from the date of this order. Upon such deposit,
WBSEDCL shall immediately restore the petitioner's electricity connection.
The remaining balance of ₹5,19,712/- shall be paid in three equal instalments, due in the first week of July, August, and September 2025, respectively.
It is further directed that the petitioner shall continue to pay the current electricity bills as raised by WBSEDCL on a regular basis. In the event of any default in complying with the terms of this order, WBSEDCL shall be at liberty to disconnect the petitioner's electricity supply. It is further directed that the petitioner shall make a representation before the relevant committee within one month from date for waiver of ₹4,80,983.078/- as late payment surcharge, the same shall be considered sympathetically by the committee. Depending upon the outcome of the decision of the committee, WBSEDCL shall be at liberty to take necessary steps, if any, in accordance with law.
Accordingly, WPA 4693 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
