28.02.2023 Ct. No. 29 KAUSHIK REJECTED C.R.M.(A) 858 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Jagacha Police Station Case No. 368 of 2022 dated 01.12.2022 under Sections 341/326/307/506/34 of the Indian Penal Code.

And In Re : Prosenjit Samanta ...... petitioner Mr. Pawan Kumar Gupta ....for the petitioner Mr. M. Chatterjee Mr. D. Samanta ....for the de-facto complainant Mr. Soumik Ganguly ....for the State Apparently, a free fight took place where, petitioner as well as the de-facto complainant suffered injuries. So far as the present police complaint is concerned, the injured suffered grievous hurt in the nature of fracture. Considering the gravity of the offence and nature of injury including the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 858 of 2023 is dismissed.
