A direction to secure expeditious disposal of the suit, is the ultimate relief sought for in this case. Learned advocate appearing for the petitioner/defendant submits that the suit is getting delayed for filing of several interlocutory applications. Upon perusal of photocopy of the orders passed by the learned Court below, it appears that as many as five interlocutory petitions are pending requiring decision, to be rendered by the learned Court below (vide order dated 24th February, 2021, in Title Suit No. 919 of 2018).

The only contention expressed by the learned advocate appearing for the petitioner is against the delay caused in the disposal of the suit, referred hereinabove.

In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.

Service upon the opposite parties is thus dispensed with.

Accordingly, Civil Judge (Senior Division), 2nd Court, Barasat in Title Suit No. 919 of 2018 is requested to ensure expeditious disposal of the pending suit, after causing disposal of interlocutory applications, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

This order is passed without going into the merits of the case, and without prejudice to the rights and contentions of the parties.

Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.

With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
