In the matter of : An application under Sections 397/401 read with Section 482 of the Code of Criminal Procedure. The petitioners approached this court challenging the proceedings relating to Case No. C/55878 of 2009 pending before the learned Metropolitan Magistrate, 9th Court, Calcutta under Sections 163,196,301 and 372A of the Companies Act, 1956 as also the order dated 21.11.2009 passed by the learned Chief Metropolitan Magistrate, Calcutta wherein the learned Chief Metropolitan Magistrate, Calcutta was pleased to take cognizance of the offences and transferred the case to the learned 9th Metropolitan Magistrate, Calcutta for enquiry and disposal.

Record of this revisional application reflects that the petitioners have relied upon the certain documents which are not of unimpeachable nature to be considered by this court in a proceeding under sections 397/401 read with Section 482 of

the Code of Criminal Procedure but are to be placed at the trial for proper adjudication.

Having regard to the observations made above, I am of the view that the revisional application do not call for any interference at this belated stage.

Accordingly, the present revisional application being CRR 593 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.
