(VIA VIDEO CONFERENCE) Mr. Siddhartha Ruj ...for the petitioner Mr. Ashim Kumar Ganguly Mrs. Sukla Das Chanda ...for the State The grievance of the petitioner is directed against a declaration by the respondent authorities in a land acquisition case being LA Case No. 4/34 of 1999-2000. Pursuant to an earlier direction of this Court the Additional Land Acquisition Officer, South 24-Parganas has passed an order dated 02.03.2020.
The State-respondents are represented and submit that in compliance with an earlier direction of this Court passed in this writ petition the order dated 02.03.2020 has been passed by the appropriate State Authorities. A copy of the said order is also filed in Court and has been served upon the petitioner.
In view of the order having been passed there is no purpose in keeping this writ petition pending. Hence, WPA No. 2083 of 2016 is disposed of.
There shall be, however, no order as to costs. It is made clear that there is no expression or adjudication on the merits of this case and all points are
left open to be decided in the proposed writ petition to be filed by the petitioner.
The petitioner is granted liberty to assail the order dated 02.03.2020 and take all points available to him in an appropriate proceeding in accordance with law. (Ravi Krishan Kapur,J)
