Mr. Sabyasachi Chatterjee Mr. Omar Faruk Gazi Ms. Ayasha Najrin Ms. Susmita Das ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 7th Court, Alipore, District-South 24-Parganas to dispose of the Title Suit No.3401 of 2010 expeditiously. The learned advocate appearing for the petitioner submits that the issued have already been framed and the suit is being adjourned from time to time.

It appears from the order sheet appended to this application under Article 227 of the Constitution of India more particularly the order dated July 25, 2024 that a date was fixed for taking steps by the plaintiff/petitioner in respect of the substituted defendants. No material has been produced before this Court to show that such service upon the substituted defendants have been effected. It appears that the suit is not ready for hearing. In view thereof this Court is not inclined to pass any order for expeditious hearing at this stage.

With the above observations CO 709 of 2025 stands disposed of.

There will be no order as to costs.
