Petitioner states that he submitted a representation dated 14.02.2025 before the concerned police authorities being the Officer-incharge, Tarakeswar Police Station. It was specifically contended in the said representation that he was subjected to assault with fists and blows by the adjacent land owners who happen to be the private respondent nos. 4 to 8.

Learned advocate for the State has submitted a report. Report reflects that the police authorities on receipt of such information have

drawn up proceedings under section 126/135 of BNSS on or about 25.02.2025.

Having considered that the police authorities did not find any cognizable offence for registration of a case, petitioner is granted liberty to approach the jurisdictional magistrate by way of invoking the relevant provisions of law.

Learned advocate for the private respondent on the other hand submits that the nature of the dispute complained of is civil dispute.

Having considered the agony and anxiety of the petitioner I direct the police authorities to oversee that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 4699 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
